DELHI: The Gautam Budh Nagar District Magistrate recently summoned over 20 developers operating in Noida and Greater Noida for handing over apartments without registration.
Devesh, a resident of Amrapali Princely Manor in Sector 76, Noida has been staying at the apartment he purchased in the project for the past year and half. However, despite paying all the charges and having moved in with all his possessions – Devesh still has no legal rights over his property. And this is because of the developer's failure to get the all-important Completion Certificate (CC), without which the apartment cannot be registered.
A survey done by Additional District Administration (Finance) of Gautam Budh Nagar plant that over 25,000 home buyers have occupied apartments without registration. In Noida and Greater Noida, the government accept failed to recover over Rs 10,000 Crores payable as land dues from developers, because of which CC has non been issued to their projects. Defenseless in the middle are domicile buyers, who are fabricated to suffer in spite of paying several registration charges to the developers earlier they are handed over the possession based on fit outs.
And at present, the courts have stepped in, with District Magistrate NP Singh recently summoning over 20 developers and warning them of strict action.
"Builders were told that if y'all are non promoting the registration before possession and if yous have got the deposit of the stamp coin from the buyers and not facilitating the heir-apparent in the registration and so you (developers) will exist liable for criminal activeness and also the penalty. There is a loss of Rs. 700 Crores to the acquirement (department)," stated NP Singh, district magistrate of Gautam Budh nagar.

Wherever the developer has not practical for CC and has given possession is wrong and wherever projects are not consummate they should not handover the project," says Deepak Kapoor, President of the Western Upward chapter of developer lobby CREDAI.
The District Administration has given two months' time to the developers to get their housing projects registered or else face the consequences. In instance you have been living in a flat without registry and so you have an escape route. A heir-apparent can pay stamp fee direct to Up Stamp and Registrations department to avoid whatever penalties.
